Terms & Conditions
1.0 Interpretation
(a)
- "Customer" shall be
the person or company
who accepts a quotation
for the installation of
the goods or services.
- "Goods" shall be the
products that Apollo
Carpets & flooring Ltd.
is to supply.
- "Contract" shall be
the Contract for the
Services offered by the
Company
- "Company" shall be
Apollo Carpets &
flooring Ltd.
- "Completion" shall be
the final date at which
the flooring
installation is
completed.
- "Fitter" shall be the
person sent by the
Company to fit the
flooring
- "Price" is the total
price for the services
offered by the Company
- "Services" shall be
the flooring
installation work
carried out by the
Company on behalf of the
Customer- - "Estimate"
Price for supply
materials and labour to
install flooring
2.0 Basis of the sale
(a)
The Company shall sell
and the Customer shall
purchase the Services as
detailed in the Contract
and mutually agreed by
the Company and the
Customer. The Customer/
main shall read these
Terms and Conditions
thoroughly before
agreeing to any services
offered by the Company.
By agreeing to the
services offered you are
agreeing to these Terms
and Conditions. If the
Customer has any
confusion over any of
the Terms and
Conditions, he/she must
clarify this before they
agree to the Services.
(b)
The Customer's signature
or a work order on the
Contract constitutes as
a legally binding order
by the Customer or a
work order with a
purchase order number.
(c)
Only the work detailed
in the Contract will be
carried out by the
Company or its sub
contactors. Any
additional works carried
out will be at an
additional cost agreed
with the customer prior
to floor installation.
3.0 Price
(a)
The Customer shall agree
to pay the Company the
Price as mutually agreed
on the written Contract.
The price shall remain
fixed for 30 days from
the date of the
Contract. The Company
reserves the right to
change the prices of its
services from time to
time to reflect the
change in living costs
or suppliers costs.
(b)
The price estimate is on
the agreement that the
Fitter or Apollo Carpets
will find no faults or
hindrances before
fitting takes place. Any
unforeseen obstacles
could result in the
termination of the
Contract or new Pricing.
The Company reserves the
right to amend the
Contract by the amount
of any extra costs
arising or incurred by
the Company occurring
before completion of the
works as specified in
the Contract.
4.0 Terms of Payment
(a)
Payment is due with 30
days of invoice, only if
agreed at start of any
contract between main
contractor and Apollo
carpets can it extend
further then 30 days.
(b)
In the event that any of
the payment is not be
paid within 30days of
the due date, 2.5% per
month will be add to the
bill.
Any outstanding
settlement figure by
main Contractor must be
for filled with in 1year
of invoice date.
5.0 Floor Installation
and Completion
(a)
Installation of the
Goods shall be
undertaken by the
Company strictly in
accordance with. And
British standards BS8203
the installation of
resilient floorcoverings.
BS5325 the installation
of textile
floorcoverings and these
terms and conditions.
(b)
The Customer must ensure
all rooms are cleared
prior to floor
installation unless
costed for. If rooms are
not cleared, the Company
takes no responsibility
for damage that may
occur to furniture,
walls, doors etc as a
result of the Fitter
having to clear the
rooms. The Fitter
reserves the right to
refuse to fit the floor
due to the rooms not
being cleared. The
Company will then
arrange another time for
the Fitter to return to
fit the floor. This will
therefore incur an
additional cost to the
Customer for wasted time
and wages.
(c)
If work can not be
commence on arrival due
to sub floor problems
etc This will therefore
incur an additional cost
to the Customer for
wasted time and wages.
(d)
Any change in material
or colour once ordered
cannot usually be
changed, but some times
can be restocked for a
small fee dependent on
manufactor.
(e)
Completion of the
Contract shall take
place on completion of
the floor installation
and the Customer will
Sign off the work.
(f)
Any changes to the
original Contract will
be agreed and signed off
by the Customer before
they are carried out.
Any disputes after this
Sign off will not be
rectified.
(g)
Due to the cost of
loading and landfill
tax, carpets and old
flooring that is
uplifted in order for
the new floor to be laid
will not be removed by
the fitter. It is up to
the Customer to dispose
of his/her own waste.
Flooring and Rubbish
will only be removed if
this has been priced
into the Contract.
(h)
It is the Customers
responsibility to make
sure the sub floor is in
the correct condition to
lay on. If a survey is
not carried out the
Company accepts no
responsibility for any
movement etc to the
floor as a result of
damp or uneven flooring.
6.0 Company's and
Customer's rights to
cancel
(a)
When an order is placed
a contract exists
between the customer and
Apollo Carpets &
flooring Ltd
.Cancellations are not
normally acceptable, if
a customer cancels and
Materials have been
ordered, materials may
able to be restocked for
a small fee, if not the
customer will be charged
to the value of the
goods.
7.0 Warranties and
Liabilities
(a)
All Services are
guaranteed for 1 year
from the date of floor
installation. Material
is guaranteed by
manufactures warranties.
(b)
The Company shall be
under no liability
whatsoever in respect of
any defect arising from
subsidence or building
movement. Nor shall the
Company be under any
liability for movement
due to damp. It is the
Customers responsibility
to get the sub floor
checked by a qualified
surveyor prior to
installation and to make
sure the sub floor is in
the correct condition to
lay on.
(c)
The Company shall be
under no liability under
the above warranty,
condition or guarantee
if the Price of the
Contract is not paid on
the due date from the
date that the payment is
due until such a time as
the Price is paid in
full. The Customer’s
statutory rights are not
affected. If the
Customer has any doubts
as to their statutory
rights they should seek
independent legal
advice.
8.0 General
(a)
This Contract shall be
subject to the
jurisdiction of the U.K
courts and constructed
according to relevant UK
law.
(b)
The company reserves the
rights to change these
Terms and Conditions
from time to time. This
will not affect the
Terms and Conditions
that are agreed by the
Customer.
FURNITURE
1. Payment
"Goods" means all or any
of the items listed on
the invoice. Payment
must be at point of sale
or on delivery of goods.
When orders have to be
placed for goods that
are not in stock a
deposit of 25% must be
paid in advance.
2. Website Inaccuracies
All sizes quoted are
approximate. Display
products in store and on
the website are examples
of the finished product.
Goods may have a slight
variation in colour,
finish, shade and grain.
Wood materials may have
minor technical
differences and their
appearance may differ
slightly from the goods
shown. Any changes will
be of an equal or higher
standard to those
displayed.
3. Access
We will place the Goods
in the room of your
choice at the delivery
address, provided that
the room is clear; and
the route from the
delivery vehicle to the
room is also clear.
It is your
responsibility to ensure
that the Goods will fit
into the intended room
and that they will pass
through all doorways,
stairs, gates, alleyways
and any other physical
features between the
delivery vehicle and the
room, without specialist
lifting equipment.
Where access is not
possible when we attempt
to deliver, alternative
arrangements will be
considered at your
expense.
For the purposes of this
contract, the term
“clear” will include
being free from any
property which may be
damaged when making the
delivery.
It is your
responsibility to inform
us, prior to delivery
(see contact details
below) of all issues
which may affect the
delivery and to overcome
those issues.
Cancellations cannot be
accepted on the grounds
that the goods will not
fit into the location or
access to the location
is not possible. At our
discretion we may offer
alternative goods of an
equal or higher value,
but in the case of
higher value goods you
will be required to pay
the difference in value
before delivery.
